Short answer

Why undeclared work puts you at risk, what rights you still have, and how to get help safely.

Information, not legal advice. MovItaly is not a law firm. Check with the questura or consulate before you act.

Who is this for

Anyone who is offered or already does work without a written contract, without payslips or without contributions being paid. Lavoro nero is illegal for the employer, and you are the one who loses most.

Your rights even without a contract

  • You have the right to be paid for work done, including overtime, holidays and TFR.
  • You can claim before a labour judge or via a union.
  • Irregular status does not remove your right to be paid or to be safe at work.
  • If you are a victim of serious exploitation or trafficking, you may be eligible for a special protection permit (art. 18 and art. 22, c.12-quater of the Testo Unico Immigrazione, TO VERIFY) without being expelled.
