Short answer
What the three forms of protection mean, who qualifies, how long permits last and what rights come with them.
Information, not legal advice. MovItaly is not a law firm. Check with the questura or consulate before you act.
Who is this for
Anyone who fears returning to their country, or who wants to understand what protection means in Italy. Reading this is safe and private.
Requirements
Italy can protect you in three main ways.
- Refugee status. You have a well-founded fear of persecution because of race, religion, nationality, political opinion or membership of a social group (this can include gender or sexual orientation). Residence permit: 5 years, renewable.
- Subsidiary protection. You do not meet the refugee definition, but you face a real risk of serious harm if returned: death penalty, torture or inhuman treatment, or indiscriminate violence in armed conflict. Residence permit: 5 years according to AIDA (July 2026). TO VERIFY with your Questura.
- Special protection (protezione speciale). You cannot be sent back because of the principle of non-refoulement (risk of persecution, torture or inhuman treatment) or other constitutional or international obligations. Since Decree-Law 20/2023 (law 50/2023) it cannot be requested directly at the Questura. The Commission or the court grants it inside an asylum case. Residence permit: 2 years. The old explicit ground of protecting private and family life was removed from the text, although courts still refer to Article 8 ECHR in some cases. TO VERIFY current practice with a lawyer.
Steps
- Read "How to apply for asylum in Italy" (protection-how-to-apply).
- Tell the Commission everything about why you cannot go back. The authorities examine every category; you do not need to choose.
- If you get a lower status than you hoped, or a refusal, you can appeal. See protection-appeals-and-deadlines.
Costs & timing
Applying is free. Decisions take months.
Common mistakes
- Thinking you must pick the right category. Tell your story; the Commission checks all of them.
- Thinking you cannot apply because you arrived without papers. Irregular entry does not stop you from applying.
- Hiding painful facts out of shame. Sensitive facts (violence, trafficking, sexual orientation) can be told to an officer of the gender you prefer.
Rights in brief
All three statuses allow you to stay, work and use public health care. Refugees and subsidiary holders can apply for citizenship after 5 years (refugees) or 10 years (subsidiary), per AIDA. For special protection, work is allowed but conversion to a work permit is limited (protection-converting-permits).
Where to get help
Free, confidential help exists. You never need to pay anyone to apply or to appeal. See "Free help for people seeking protection" (protection-free-help-directory) and the UNHCR Italy help site (https://help.unhcr.org/italy/). If you are in danger now, call 112 (free emergency number).
